How to Form an LLC in Alabama


Create a Domestic Company

Step 1 – You will need to download the LLC Certificate of Formation. When completing this application, be sure you choose a company name that has not yet been registered previously with the Secretary of State’s office by searching the database.

Step 2 – Make two (2) copies and write a check in the amount of $100 payable to the Alabama Secretary of State’s office. Also, make sure that you verify with the county you reside in (See Judge Probate List) to ensure there are no other fees when incorporating.

Step 3 – Fax the original form or mail to the Judge of Probate’s office in your area. Your new LLC (unless there are any issues) should be processed in about 7 to 10 business days.


Create a Foreign Company

Step 1 – Download and complete the Foreign LLC Articles of Organization. This is the only necessary document to file when applying.

Step 2 – Gather your documents and attach a check in the amount of $150 and have sent to:

You should receive your new foreign corporation within 7 to 10 business days.


  • When creating your LLC, it is always a good idea to create an LLC Operating Agreement that spells out the rules and code of your company. Highly recommended as this is the only document that proves your entity status if you should ever be subject to claims that it is a personal asset.
  • Register and receive an EIN number so that you may be able to open a bank account, get credit cards, and start conducting financial activities.
